Clients will often ask if their new spouse’s income will affect the amount of child support they have to pay, or in the reverse, will they get more child support because their former spouse re-married? The answer is no. The child support guidelines do not include income earned by a subsequent spouse. The new spouse does not have any obligation to support their step-child. That obligation falls on the parents of the child. Additionally, voluntary contributions by the new spouse or a significant other do not count as “income” to the responsible parent.
