Nebraska & Iowa Evictions Update During COVID-19

Are you a landlord, multi-family housing property owner, or property manager? Here are some recent updates regarding the eviction changes for Nebraska and Iowa during COVID-19:

Nebraska:

Governor Ricketts issued an Executive Order on March 25, 2020 suspending evictions for nonpayment of rent. With regard to the evictions, it does the following:

  1. It only affects evictions for nonpayment of rent on or after March 13, 2020;
  2. The moratorium lasts until May 31, 2020;
  3. A tenant must demonstrate to the landlord, with documentation or other evidence that the tenant (a) suffered a substantial loss of income resulting from COVID-19 or the related state of emergency (job loss, reduction in hours of work, closure of a place of employment); or (b) missed work to care of a relative or a child due to notice from a school or a childcare facility that the child may not attend due to closure or attendance limitations related to COVID-19; and
  4. It does not prevent a landlord from evicting a tenant for a 14/30 Notice or a 5-Day Notice for criminal conduct.

Iowa:

The Governor of Iowa has declared a state of disaster emergency on March 19, 2020 and suspended evictions for nonpayment of rent until midnight of April 16, 2020.  Evictions for noncompliance with terms of the lease (7-Day Notice), clear and present danger and holdover tenants/squatters can be filed.
