Sioux City utility customers of MidAmerican Energy Company and/or Woodbury County Rural Electric Cooperative may be entitled to a settlement for overcharged franchise fees as part of a recent class action lawsuit that was settled in Sweisberger v. City of Sioux City. The eligible class members include utility customers within the City of Sioux City between September 5, 2001 and May 25, 2009. Class members also include the heirs, successors and assigns to any person or entity that paid franchise fees during the class period. In order to recover under the settlement terms of this class action lawsuit a valid claim form must be submitted to the Settlement Administrator. The Claim Form must be postmarked on or before February 26, 2015. If you are a potential member of this class action claim, forms can be obtained at www.siouxcityfranchisefeesettlement.com. The settlement shares of any potential class members who decline to receive their share, or who do not complete a Claim Form by the deadline will be distributed either to charitable recipients, to the City, or to the State of Iowa as determined by the Court.

If you received a Claim Form for this class action in the mail, the estimated refund will be a prorated amount of the settlement, after payment of attorney’s fees and expenses, to be divided among all class members and prorated based upon the franchise fees paid by each class member.
