How do you Depose a Company?

State and federal courts alike have procedures in place which allow a party to a lawsuit to obtain sworn deposition testimony from a company. Wait a minute - how can a company “testify”? State and federal laws require a company to present one or more witnesses to testify, in response to a valid subpoena served on the company’s Registered Agent for Service of Process. The subpoena will typically outline various subject matters for which the company is asked to testify. The company must then present the “persons most knowledgeable” to testify on those subject matters. The testimony of such witnesses is binding on the company.
