Nebraska Advisory Committee Adopts Recommendation of Goosmann Law Firm Attorneys Larry Roland and Joel Carney

Goosmann Law Firm attorneys Larry Roland and Joel Carney were asked by the Nebraska State Bar Association to inquire and obtain clarification from the Nebraska Advisory Committee for an opinion related to whether it was ethical and therefore allowable to use cloud based solutions in performing legal work, storing work product, and transferring case materials to clients and third-parties. 

Roland and Carney of the believed such actions were permissible under the Rules of Professional Conduct and wrote a draft opinion for the Committee’s review and consideration.  After deliberation, the Committee adopted the recommendation of Roland and Carney and issued an opinion confirming cloud use was allowable when attorneys use best efforts to prevent unauthorized access to information on the cloud, maintain confidentiality, and ensure that reasonable safeguards are taken to ensure data is protected.  For more information and a complete copy of the opinion, visit https://supremecourt.nebraska.gov/sites/default/files/ethics-opinions/Lawyer/19-01.pdf.
