The SD Supreme Court released the following decision this morning: Hyperion I & II, 2013 S.D. 10: A unanimous decision, with opinion by Justice Zinter, affirming the circuit court which affirmed the decision of the Department of Environment and Natural Resources (DENR) to issue an air quality permit to Hyperion Refining, LLC (Hyperion).
