Temporary Support Orders

August 9, 2013. If you are in a situation where you financially depend on your spouse, filing for divorce may not seem like an option even if you are in a hopeless situation. Communicate these concerns to your attorney in your pre-divorce consultation. Your attorney will be able to advise on whether or not to file an Application for Temporary Child Custody, Visitation, Support, Attorney Fees and Court costs. Your attorney can file this application with the initial petition for dissolution to expedite the hearing.

The court will look at all surrounding facts and determine if an order for temporary support should be entered. The purpose of this order is to ensure you are able to continue paying bills, to set a schedule for visitation for children, and to order child support. Often times, a trial date is not scheduled until months down the road. While you are waiting for the trial to finally resolve the legal issues, the temporary order governs.
